T1: Responsive Planning Practices for Changing Economic Times

Maintaining delivery of housing and other development in the current market downturn and into a future market recovery cycle is a challenge for the development industry, local authorities and other public bodies. A symptom of the current downturn is that a number of development proposals have either stalled in the planning process or are not being implemented.

This paper is intended to provide practical advice that can be used by local authorities and their partners to help broaden understanding of the key issues underlying stalled development schemes and identify approaches to finding solutions where appropriate, that may help unblock the barriers that are preventing projects from proceeding.

This advice is primarily aimed at local authorities and their private and public sector partners in situations where the current market uncertainties have resulted in the stalled implementation of development schemes that the parties agree there are benefits in trying to move forward. It draws on the ATLAS portfolio of projects as well as current practice in some local authorities and provides some approaches, principles and learning points that have been used to resolve issues in a collaborative and solution-focussed manner. However these are not exhaustive, and it is anticipated that local authorities and their partners will need to adapt the advice and suggestions to meet their local circumstances and challenges.

It is important to note that while adopting a positive and well-managed approach to negotiations is a key ingredient of achieving a good outcome for all, in itself, it may not guarantee that a mutually acceptable solution will be found.
